At the end of Iron Man 3 he lost his entire estate and they are not clear on him continuing to be Iron Man anymore. RDJR signed for the Avengers 2 and 3. We know at the end of the Avengers he was working of Avengers Tower. So what do you think is happening? The first Iron Man was about redemption. A multi-billionaire who controlled the arms industry and decided to become a true human being and help others, rather than destroy. Also Tony lost all his suits.

Well, he technically is still Iron Man, even though he got a new heart. He can still make a new suit at anytime.
