  1. 1. Should a person be charged for recording a person in private without their permission?

    • Yes, it's inappropriate and it isn't lawful.

    • No, people should just calm down and not care.

I see it happen all the time, especially in private areas where you are not supposed to. The person tells them to stop filming them and the other just keeps doing it just to get views on youtube. I think whoever did it should get a fine or arrested for unlawfully recording another person(wiretap laws?).

What's your take on the issue? Should it be fine for people to do this? Or should the person be charged for unlawful wiretap(recording without permission)?

Simple, people are morons.

Have the courage to think and act on your own. And have the courage to disobey.

Your basic right is actually pretty simple: if you're in a public place and you can see it, you can shoot it. This means as long as you're in a public location you can legally take almost any picture. However, if you're using a telephoto lens, parabolic microphone, or hidden camera to get a shot of a private property when you're standing on public property you might have an issue if someone on that property has an expectation of privacy. So, what constitutes a public place? Most places are obvious, a park, a street, a soccer field—these are unquestionably legal places to take pictures of anything happening. But what about all those Instagram photos of food you've taken inside a business? That's a little different.

Generally if a private property is open to the public (like a restaurant, retail store, tourist areas, etc) you are allowed to take photographs and video unless it is expressly posted somewhere on the premise that you can't. In most cases it's okay to assume you're allowed to take pictures and video in a shop that doesn't expressly forbid it. However, if a property owner (or store employee) tells you to stop, you have to stop. More importantly, use good judgement and assess the situation and environment before snapping pictures.

This also goes for citizen journalism. If you see an accident you want to record, public servant misconduct, or even TSA checkpoints, you can do so as long as you're not interfering with police or medical operations. As far as the Department of Justice is concerned you're also allowed to shoot video or still shots of police officers provided they're on public land. Videotaping police officers is still a tricky situation without a concrete ruling, but the courts have leaned toward protecting your right to film officers.

Basically its kind of a so-so situation....those youtube people who pull pranks are part of that so-so situation (i never watch them that much, but its funny to see some people get pissed off) also, some youtube channels actually confront some of the people after shooting the video and obtain their permission to have their face blurred or not (most people do, not all, but some)

"What are you trying to accomplish, putting yourselves in danger like that? Trying to see "justice" done? Is that really justice, though? Aren't you just doing this because you want a little spice in your boring lives? What's the difference between that and a criminal who gets his kicks by murdering people? You see what I'm getting at? There's still a lot of time left. Give it some thought."

I don't see how it is funny to see people get pissed at all. I think it is aggravating how it is seen as humorous(in my humble opinion, the humor comes from hidden human feelings of seeing others have worse problems than them, which feeds them psychologically), but okay.

its just my sense of humor i guess, sometimes i go "why the hell did the guy behind the camera do that?" i mean there are some reactions that are justified, some are just like wtf?

That isn't the reaction that I am talking about. People get a high off of seeing things happening worse to other people by watching these videos that others make to look funny, but in reality harm the other person.

Oh toaster flipping rabbits. o.o

I hate it when people do that....especially if I ask them not to put me on Facebook, and the do it anyways to get likes. Not even ask my permission either....I don't care how cool my party was or whatever. -.-

Yes...they should pay the price.

true i do hate when people post things on facebook when im like "DONT YOU DARE POST THAT" then three hours later you find said video on facebook. (hence whenever i record someone doing something i always ask first, generally its something small)

if it is in public i dont care if they record or not since they have no grounds at all, their complains mean nothing.

on private its obvious you got grounds to sue.
