Why is it such a bad thing to say that fanmade art should be C&D'd?

What exactly do you mean? Do you think that every single fanfiction, fangame, fan song, and fanart should have to get permission to be made first? Or are you only referring to larger projects?

Larger projects, such as Onlyfactory, which got C&D'd a couple days ago.

I wouldn't nessesarly say that its a bad thing to have that opinion, but I do think it sucks when artists have been working on something for a long time and they're forced to stop. I think Hasbro generally only issue C&D's when the fan work looks to close to the show, though. So I usually understand where they're comming from.

Also if fanmade things got put up that was related to gore or something and it looked almost exact to the show most people would get put off MLP so hasbro would loose viewers and money which prevents them from being aple to pay important things for thr show

Animation projects that use the leaked Hasbo owned puppets from the show have been given ample warning to stop from Hasbro and other creators. It's not a smart idea legally as they are stolen property. That isn't anything new. Feel free to dig up prior threads on why this is an incredibly bad idea for fannon creators to do so. That's the only big C&D'ing i've seen outside of Fighting is Magic and very other rare instances. Content makers continue to make fannon, Hasbro is generally out of the equation unless its mass merchanised (through We Love Fine), and nobody really gets that butt hurt about it. 99.99% of fannon goes on uninterrupted.

Well if you MASS manufacture unliscenced plushies (that Hasbro does not make a cent on) then of course you will be eventually taken down. How is this a surprise?  Businesses can't do this.....

With the way the law works Hasbro needs to show a bare minimum of "protecting" its patents otherwise it loses them completely. It is a messed up system but it the one we are working with now. Fortunetely they are able to show this bare minimum by still allowing most fanworks but only go after the really major ones. Copyright and patent laws still need to be changed though, but at least Hasbro is one of the more reasonable companies out there. There are some companies that will go after you for even the slightest thing.

It would be perfectly ok for something to be taken down only if the following: They're making money off it, claiming the IP as their own, and/or using the leaked animation puppets when doing animations. Other than that, there's no reason for the fanwork to get a C&D, they'd just be using copyright as an excuse.

 

Having to just ask Hasbro for permission to make everything related to MLP (or any of Hasbro's properties) is totally asinine. That's just how I personally see it.

I hate C&D because Hasbro doesn't realize that many fans came from the fanworks and fandom and by C&Ding them Hasbro is losing fans

You see, fanart isn't like a lot of other stuff, like fan videos, such as Button's adventures. The vast majority of fanart has their own unique style. Also, there's so much fanart that C&Ding it would be pointless, considering how much of it is made. C&D one, another one would come up, and so on, and so forth. One last thing, are you seriously saying fanart should be C&Dd? Because that's kind of harsh. Do you not like fanart?
