Should I give up on YT?

I'm giving up on YouTube for now anyway. Here is my little story/rant:

I uploaded a PMV (Pony Music Video) and I made it look nice with some little effects and I used one of the songs from my library. My video is protected by Fair Use that doesn't seem to stop the copyright trolls. The holder I think is Hasbro, because after I submitted a dispute (claiming fair use) I get a responses saying "Dispute rejected, claim has been reinstated". I am just going to delete and remake my videos I guess...

I am learning to make music so maybe I can use that whenever I learn how to :P.

I believe you have to mention that Hasbro owns MLP and they wont complain as much. But the whole copyright thing is a bit over used..

Well in the description I made sure to put that I don't own MLP or anything like that. I also put in this:

Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use.

they cant stop you for recording games.. there are WAY to many who do the same thing that the companies dont have time or money to go around and cry about copyright xD

I really wonder what has driven Hasbro to go so bonkers over things on YouTube. Do they realize how detrimental this is proving to be?

It could be because the show is up for syndication which means they want to air reruns on another network. Let's say that Hasbro wanted Cartoon Network to air reruns of MLP. Cartoon Network won't pay to air something that could easily be found on YouTube.

I going to assume that Hasbro is hurting for money if they are going after fan made stuff.. but why stop now? continue to make things until they give up, because we sure wont

They're not "going after fan made stuff." They're up for syndication so they don't want the show to be on YouTube anymore, because a network isn't going to pay to air something that could easily be found on YouTube.

Oh, and about Fighting Is Magic. Hasbro is protecting their IP. They don't want MLP being associated with violence, and mane6 made it way too public, which is the reason Fighting Is Magic got a C&D and Cupcakes didn't.

Well, i made a Left 4 Dead 2 mod where i replaced the credits song with a remixed version of Winter Wrap-Up.

I uploaded the video to YouTube and it got flagged for copyright from Hasbro LLC or something like that.

I mean c'mon! I had the description and whatnot that everyone else used and it still didn't work.

So i deleted the video and re-uploaded it and i didn't put the description in that i needed

and i haven't gotten a copyright flag yet.

Sorry, but i'm tired of this stuff. Its like hating people for loving their music.

Whatever though, i'v been going through this since YouTube revamped their whole copyright terms.

Welp some random dude on YouTube has just torn me a new one... the worst part of it is I think he is right

I am not sure if I should feel pissed off or incredibly stupid. I feel both...

The sad part is he is, fair use law is a complete and total joke. The way it is written is so ridiculously complicated and convoluted that the only "fair use" that is ever truly respected is whichever major corporation has the slickest lawyers. You shouldn't feel stupid, you should feel pissed. Laws are supposed to be written to apply equally to everyone while copyright laws favor powerful corporations at the expense of everyone else.

It is what prompted me to start this thread a while back

which inspired this thread

For the record I'm not trying to demonize Hasbro or any other holders like some people on this site do. I am just annoyed at the moment.

Hasbro is not paying attention to the "fair use" laws. They're going WAY too far with this issue. A PMV is something that someone creates giving credit to what their music video is about. This is a clear example of hasbro using a legit fallacy just so they can "protect" their property. This right here, is copyright trolling.

The videos have been deleted I am thinking about uploading them elsewhere. Sorry, but this is not worth getting sued over regardless of who is right or wrong.

If you used a well known song that could be why you got copyrighted, not because of the ponies. Same thing happened to me when I tried to credit my use of ACDC music. Now I have to shout “I DON’T OWN THE MUSIC” in the description if I wanna use anything.

Basically any time you upload ANYTHING with even the smallest, shortest amount of copywritten content, video, audio, especially music, you have to be prepared for the possibility it will be taken down. Sometimes you can get away with it being up for weeks, months, even years before it happens, sometimes it's automatic.

That will do nothing. Saying you don't own something and using it anyway will still get your vid taken down if you're using the music. There are some ways around this, if you use the music in short bursts for a few seconds here and there. But uploading a whole song? don't be surprised when it gets removed/blocked.

I looped one segment of a song for a couple of seconds and that’s what ended up getting banned. I’m honestly not sure what the completely correct method is now cause I use a lot of YouTube songs instead to avoid copyright.

any song you can think of probably has some company claiming ownership of it. Meaning that any time you use a song, it's likely that your vid will be taken down. You'll have to use music in the public domain, or chop it up to dodge the strike.
