As a judge would you condemn a Human or Pony of the same crime to get an equal sentence?

 

ExamplesPony murders a Human. Human murders a Pony. Human murders a Human.  Pony murders a Pony.

 

Would you give a lesser sentence depending on one's species? Or would you make Pony and Human have an equally bad sentence? 

 

Or would you over the fact because your a Brony give the Pony a lesser sentence? Thus enforce a double standard.

I think that if a creature Has a free mind instead of Animal instincts and could deciede what they want to do then they should be punished for their sins.

a creature that did something wrong for survival or to feed itself should be spared.

Favoring one over the other would show a personal bias and mean that my judgment was fatally flawed.

 

Plus, if one knew that they would get a lesser sentence from the same crime there would likely be repeats as others would be confident they could face a less-harsh penalty or attempt persuade a proven to be bias judge.

 

Therefore, I believe an equal sentence should be given out as both species are sentient, able to differentiate between right and wrong, and be held accountable for their actions with the same standard.

Well the fact that the pole was fair or double standard judge kinda seems bias but definetly equal sentence they have an equal intellectual level as us

When it comes to violent crimes, what I'm most concerned about is the fact that it's a violent crime and that the person (or pony) in question is unsafe. Emotions like vengeance and the desire to punish should be as close to nonexistent as possible in the court, and only emotional judgment would give one unsafe creature either a lesser or more severe punishment than another creature who is unsafe in the same way and to the same extent.

the species of the one who is doing the Judging might factor in as well.

 

Pony judge might pass be greater/lesser Judgement and vice versa.

 

kinda like how if a man kills a man its horrifying and evil yet if he got mangled by a tiger its nature and his own fault for being there.

 

Over all i'd say a Pony Judge wouldn't be as harsh as they have more options on how to punish the convincted besides jail and death. one example being the 'reformation' spell.
