So I made a video mixing some MLP FIM footage and the opera song from the JG Wentworth commercial. So is there anything I should do or anything I should put in the description to avoid copyright issues?

If you want to totally avoid copyright issues, don't make the video. Using copyrighted material is always a minefield. If you want to try and mitigate them, cite all your uses during the video (usually at the end). Don't monetize and you shouldn't run afoul of anything Fair Use shouldn't get you out of.

But I already made the video and it's pretty funny. >.<

Okay. I'll do that and just hope for the best. Xp Thank you for the reply. :D

  • 4 months later...

There are tons of PMVs out there and they seem like a common trend. Generally what you're doing is copyright infringement, but everyone seems to tolerate it anyway. The worst they usually do is take down your video should the copyright holders choose to do so, but they seem to allow most of these types of vids.

Of course, it doesn't hurt to cite your sources. :)

Just putting that out there. Seeing that this was made literally months ago, do you have the video up anywhere?

Here's a way to avoid copyright infringement: Don't use anything from Nintendo ever. No but really though Nintendo is evil when it comes to copyright.

More related to this however just try to stay within fair use and don't monetize it. That'll help avoid problems.

The surefire way I've seen people do it- is just flip or mirror the video. I have never seen a video get taken down using mirrored footage. Be careful though, just because I haven't seen it happen, doesn't mean it won't.

;) I agree though, best way to prevent it from happening is to not use the creator's content with out permission in the first place.

Thanks for the advice. :) Here's the video. https://www.youtube.com/watch?t=1&v=zhVffWSwY_Q

I made it using Windows Movie Maker so I couldn't really get fancy with it. Hope you like it anyway. :squee:

So long as it's yours and not someone else then you should be fine.

Yeah but almost everything in his video is from somewhere else... it's kind of tricky to put something on the internet these days, but he can always upload it and see what he gets (most of the time it's fine, many AMVs on youtube are still there even from a few years back).

At least you didn't upload anything from nintendo/sega/fox/disney, that's going to make you lose that video in a few seconds...

The usual way that people attempt to avoid claims is through Fair Use. Typically this means that the person using the footage has to provide some critique over it (because fair use lists commentary and critique as accepted exceptions to claims). If your video has already been claimed against, you will need to either figure out which policy your video is being claimed against and whether or not it is accurate. If it is not accurate, submit a counter-claim against them for YouTube to review it.

If it does violate the policy, there is not much else you can do aside from altering the video and re-uploading it to meet their guidelines.

Crop the videos a little bit and change the pitch of the songs you use slightly. It won't always work but if you really want to use the copyrighter material that's my best advice.
