researching What does Forums do about Art Theft?

It says that plagiarism is prohibited in the guidelines, but I'm also curious about the process  Do you need proof that the art is someone else's before the thief gets banned, or are they banned if the art just seems stolen? 
By "thief" I mean someone who says that the art is theirs'.
