Discordian 6,015 March 13, 2012 Share March 13, 2012 So I heard from someone who lives across the country from me that he saw a guy go into McDonalds to get the toys and when he said they were for him the General Manager was called and the guy started ranting about how he had heard of these "Sick fucks" who got these toys and liked this show and the store had a no tolerance policy for them and refused to sell to this guy. He then walked out shame-faced and on his way out got called a faggot. My question is...are they allowed to do that? I don't think they are allowed to refuse a sale to someone as long as they are not disrupting anything. Hell, I know they can call the cops if he had refused to move until they gave him the sale but it's honestly very disturbing to know there are people out there who will literally refuse a sale because of some rumor they heard from their boss who likely made it sound worse than it is. Shame on the manager for treating the customer that way and shame on the guy who walked out without saying a single word. Sickens me to see such behavior from adults. On the bright side, he was insulted by a McDonald's Manager. They often think they're the boss of everything. But the fact he walked out without saying a word doesn't help the matter. It's too late and I'm too far away. McDonald's, like most businesses, has a policy of reserving the right to refuse service to anyone. The store owner, however, acted highly out of line with his insult directed towards the customer. Refusing a sale is one thing, but berating a customer like that isn't acceptable behavior. You can hear any rumor but without positive and definitive evidence that this particular person was one such "sick fuck" then he had no right to call him that. Even if he can't start a lawsuit on it he could still very well get that manager taken down from his position because of that, especially if anyone else who was there backed him. The problem is that we have no way of verifying if that was actually what was said or not. You need more solid grounds for a real lawsuit. There are too many frivolous lawsuits as it is, and unless there's some definite proof, or at least a few eye witnesses, this one wouldn't even reach the courts. Used to be known on here as Kyronea. joeyh3 153 March 13, 2012 Share March 13, 2012 (edited) I'm not a lawyer, but from what I know about business law, there's nothing illegal about refusing the sale - the manager runs the store, and the law says that if he doesn't want to sell something, he doesn't have to. However, the verbal assult that followed is definitely illegal, and could easily result in a harassment/discrimination lawsuit. Additionally, while the law says he can refuse a sale, I'd be willing to bet that McDonald's corporate policy says he cannot. McDonalds wants to make money, and to make money, you need good customer relations. If you're refusing a sale based on personal bias, that's bad customer relations, and thus bad for business. Additionally, they'll also likely have policies in place that prevent discriminating against customers, creating disturbances, etc, all of which this manager did. Whenever I'm dealing with a situation where customer service has been less than adequate, the best resolution is just to contact their corporate offices. He should send them a detailed email, outlining dates, times, exactly what was said and what happened, names if he caught any, etc. He needs to express that he was upset with the situation, but not use an angry tone in the email (no caps lock abuse, swearing, etc). I've found that every single time I've done that (which, thankfully, is not very often), the corporate offices have been more than willing to work with me to resolve whatever situation happened. If he was being disruptive that'd be a different case but all he did was ask for the MLP toys and say they were for him and they got the manager who went off on him. (Remember: This is a third person narrative as I was not actually there and heard it from someone else) That alone is against customer service policy. I can't believe the manager would treat a customer that way though...Calling him a "sick fuck" and a "faggot" is extremely insulting and uncalled for. I agree that it is discrimination and is probably illegal. The customer should definitely file a lawsuit or do something to get that manager fired.
