Will Hasbro C&D the entire fandom?

....will Hasbro take down all the creative side of the brony community, like all pony fanart, fan music, videos, websites, etc. I even read an article somewhere that Hasbro is even claiming copyright over "bronies" so it would be illegal to post anything MLP related anywhwere w/out being taken down, sued, or banned. Basically it will be illegal to be a brony or does Hasbro own us? I'm always reading about YT channels, custom businesses, videos, artwork, vectors, just being taken down due to copyright. I'm going to be in big trouble when that time comes and Hasbro sees all my pony content on the internet.

Now im no legal expert,but from what i understand Hasbro is only taking down content that could be mistaken for the actual show.

For the most part, Hasbro has left everything alone.  For whatever reason, there are certain fan projects they've taken actions against and sent Cease and Desist orders too but it doesn't happen often.  Even if you were to get a take down request, it doesn't mean you're going to be in any trouble... a take down request is just that... it's them asking you to take down the content.  Once you remove it from Youtube or whatever site it's on, there's no issue anymore. 

What it boils down to is don't worry about it, and if you get a take down request do what they ask so you don't have issues.  As long as you're not pirating, you'll be fine.

To be a brony is to like the show and acknowledge that you are, in fact, a brony. All the other stuff is superfluous and not an inherent part of the definiton of a brony, more of a byproduct.

Hasbro is lenient with the fan projects, while some projects did receive Cease and Desist though it hasn't happened recently. For now, fan content has been off the radar from Hasbro.

 

If Hasbro did C&D the entire fandom, that would be a big mistake.

I don't think classifying yourself as a brony is or ever will be illegal. That's stripping freedom rights, which America is pretty obsessed with. Also, being "illegal" would require the government to pass an actual law, and they don't care about that at all. .-.

Also, Hasbro cannot control people or claim rights for liking something, that is both impossible and absolutely insane in this day and age. .-. Makes no sense. You cannot "copyright" a person. Maybe the term, but not a person.

Meh, I willing to go to jail for my artistic integrity. It's one of the few things left that i'm willing to fight for. So Hasbro can report, ban, and jail me. But i'll just use a shiv and carve pony drawings into other prisoners (assuming i'm not killed). But i doubt that they will go that far as to start removing all brony fan work (drawings, videos, ect....). It would be a very poor move on their part.

Yes, they would most certainly C&D a money spewing fandom, that gives them enough money to gold plate their boats.

And yes, they will certainly most likely try to break US law so that you cannot refer to yourself as a brony in any media, despite still not having specific rights to that word.

Dude, if they got rid of the fandom, then there would be no show. I mean, would shows like Supernatural, Sherlock, Doctor Who, etc survive without fandoms? I just realized I named the tumblr big three...

 

But seriously, dude, it ain't gonna happen. Hasbro puts money first, and the fandom is money.

Well there's some recent story from EQD about Hasbro removing monetization on pony material from people's youtube channels when they are pay channels. I addressed this in another post here on the forums, and to be honest this content ID monetization has been going on since December 2013 baack when Youtube greatly expanded on Content ID to visual and audio content. To be honest, I don't think this has anything to do with Hasbro, but rather Youtube's Content ID system which has been around for months.

 

 

Here's a short description on Content ID. Content ID from a technical standpoint, it’s an audio and video fingerprinting system. Take an audio stream and cut it into a few bits, take the frequencies of a song and measures the data and puts them into bits. Take an audio stream and cut it into a few bits, take the frequencies of a song and measure all the data and put them into bits. Then it takes those bits and matches with the audio. If section after section has at least 50% of the audio as the same, then it’s likely a content ID match.

 

Content ID doesn’t make a distinction on the type of use whether or not it’s fair use. Companies on Youtube can either block things, or get all the advertising revenue.

 

Before with Multichannel networks, random people can upload anything and get credit, which is actually quite dangerous because there is little way to enforce it. Which is why after December, 2013, Youtube has changed its policy so that companies who are verified with Youtube can make details on whether to get ad revenue from such videos, or take down the videos.

 

Basically, Content ID is a system that favors the large organizations, multichannel networks, and companies. Hope that's informative, and as you can see, this whole thing has NOTHING to do with Hasbro C&Ding the fandom.

Well, they might not C&D the fandom, but I could see a pay to post pony feature in the future.

 

And I am confused as to how this happens, the work in the picture did not use sound, or images from mlp, but indirectly alluded to it. So since it contains no direct MLP works, I wonder how this whole situation arose.

I think the furthest Hasbro is going to go is to advertise on the creative brony art.

As far as I can recall, the C&Ds are only there when the art matches too closely to that in the show.

I don't really think Hasbro can claim bronies though! They'll have a tough time with that one anyway.

 

If we thought the C&D uproar was bad, just imagine what it would be like.

People really need to stop knee jerk reacting to "somebody told me that" stories. People really need to be better informed on what's occurring before they weight in or believe what's told to them. The Bronies thing was actually a joke made on Horse News and Hasbro has been VERY supportive of Bronies and flexible on copyright so far.

Okay time to throw a bucket of cold water on this panic party. Yes Hasbro has C&D'd stuff and there may be some projects in the future that get C&D'd and it sucks that this happens but much of this is because of the messed up ways that copyright/patent laws work. Legally Hasbro has to meet certain minimum requirements to show they are protecting their patent otherwise they lose it, but Hasbro also knows that a lot of fanworks are good free advertizing for them.

 

Because of this Hasbro has been much more lenient of fanworks than other companies who have aggressively gone after every fanwork they could possibly find, they allow most fanworks to exist while only going after the ones that directly threaten their patent. If you are going to be angry at someone than be angry at these companies who buy off these policies and pass these ridiculous laws take a huge crap on the 1st amendment and give big corporations and unfair advantage. Getting mad at Hasbro is not going to change anything, what will is changing these laws which will not be easy but is something that needs to be done.

 

Hasbro is never going to go so far as to bar all fanworks, even if they wanted to they couldn't possibly do that. The sheer amount of costs of lawyers, subpeonas and other expenses will bog them so far down that it could ruin them.
