That is the most ridiculous type of jealousy I have EVER heard of.....

 

They're a company. As a company, they aren't going to accept fans making fanworks off their property and getting money involved (donation, comission, etc.).

Show me how is it that this law works that it allows for someone to "claim" an already registered product of any kind because he is making fanwork of it in a way that doesn't sound like scare tactics.

 

The C&D letter is directly on the first post of this thread. You can also read the legal warnings on youtube about not uploading content that you don't own onto youtube. Jan Animations does not own the rights to CMC or Button Mash, Hasbro does....

You know, I've had enough of people defending Jan animations. They knowingly used a character from Hasbro without permission or paying royalties. In fact I think Hasbro should go further and sue the pants off them!

 

Fun Fact: Paramount had this mentality once with Star Trek and it didn't end well for them. They were so bad with their lawyers that the fandom started a massive boycott and said that they were willing to kill Star Trek if Paramount didn't put a leash on their lawyers and it worked.

Another fun fact. Bronies make up a small minority of FIM fans. So I've got a feeling that if bronies did that, hasbro would just shrug their shoulders.

Was going to be it's own independant thread but I will just post it here.

 

My current view on Hasbro's recent C&Ds on JanAnimations, and other fan made creations.

 

I've been a brony for a good while, I've seen a lot of brilliant fan made content, Double Rainboom, FlufflePuff and Button mash are all just examples of this However Hasbro has not been able to see the side of the fans in some of these cases.

 

It is understandable that as fanbases grows, the risks of trademarked/copyrighted content being stolen is a much more notable problem then it ever is.

However, the distinctive setting, characters, art style and base of lore and stories that resides within the MLP:FIM series is very easy to notice and sometimes creators of fan content do not feel the need to broadcast in every creation that the franchise the art is made from is not theirs, and you know what?

They should not need to, as long as the creator states that his work is inspired from a trademarked franchise on for example their youtube channel page, then it should be classed as “fair use content”

 

Sadly Hasbro has had a strong mentality with protecting their product over the years, some earlier examples we had the “Fighting is magic” project taking a C&D on behalf of Hasbro which brought development to a bitter end, if it was not for fans who continued to develop the game from a beta version left over on fan's computers, which allowed the game to be finished and released for free, Hasbro's attempt to “protect” their product resulted in holding back creativity for a short period, but it did not stop it from becoming a reality.

 

Since I've just been using past examples I would like to now refer to the recent situation faced by JanAnimations, creator of the “Button mash” series, who has recently suffered a C&D from Hasbro, which has put a shallow end to the series that fans enjoyed, as far as I have heard JanAnimations has said that they will no longer be working on MLP:FIM related content due to this incident, and he is entitled to do so; I do not think it would be wise to try and fight back at a major corporation either way.

 

There has also been the removal of other fan videos, music and art. How you remove a image from the internet is beyond me but they've tried to, in attempts to protect their product and profits, they are claiming and removing content that they do not receive anything for.

 

This, is what is wrong with large corporations and broken copyright laws, they stifle the creativity of anyone if they are not benefiting them in any way that they perceive to be beneficial, this usually is going to be money, Greed is one of the seven deadly sins and every company commits it.

 

Things like this is what is causing a lot of bronies, those who have been part of the fandom for years to pack up and leave, one of my friends, one who made me the brony I am today has left the fandom because of this, and another one of my friends has left the fandom today because of this.

 

THIS DOES NOT BENIFIT EITHER THE FANS OR HASBRO.

Hasbro, like every company is blind to what gets them their money, the fans. It is the fans that chooses to watch their show, its the fans that gets them their profits and its the fans that gets the franchise to become as good as we've seen it before.

If your methods takes the fans out of the equation, you don't get money, you don't get squat if you've pissed off the fans to the extent that they boycot something that they've loved for days, weeks months or bloody years!

 

Hasbro, if your reading this or not.

You need to take many steps back, allow fair use of your content as long as they state the franchise it is from is not theirs.

If you don't I fear that this fandom, while as strong and great as it is, could fall apart under your greed, and you will be left with shambles, nothing really there for you to salvage any money from.

 

Its really down to two options isnt it?

 

Make money with a happy fanbase.

Or make no money without a fanbase.

 

Your move Hasbro.

 

 

 

In case people do see this the wrong way,

I do not hate Hasbro, I just think that they're just too prone to panicing that their content will be stolen.

Hey I'm upset too about this but you're ignoring what everyone has said in the thread already about the legal rights that Hasbro has. You can be upset all you want but its your choice how you deal with that. It's not appropriate to cuss up and down on this forum and not be knowledgable about the basics of how the legal system works with trademarks and copyrights.  

 

Feel free to write a nasty letter to Hasbro if you want to do make your voice heard and get them to see this as a pr disaster. Just don't feel you have to tear into every brony who isn't thinking that the sky is falling or that Hasbro is the big bad guy.

No offense man, but there are a lot of reasons why they could do such a thing. Providing a smoke screen for their business practices, for example. I don't think that they are OH SO EVIL either. They just exist in a system that allows for them to do much more than they should be able to, and as a corporation, all they really care about is larger and larger profits, even taking actions that are counterproductive, because they think it's advancing this agenda.

I implore you to look at his latest post, talking about how hasbro gave children gifts in his local area. The fact that he started a counter thread, and then went on to try to show how being bought off means hasbro is the good guy. Either he is trolling at this point, deliberately trying to sound as leftist as possible, or he is extremely enamored with a mega company. And this is not even close to "in-fighting", it is merely a simple argument on the internet.
