I liked those videos but Hasbro had a good reason to do it.

I don't think they wanted, its more like they were forced to. Just hear me out,

If Hasbro did not enforce their copyright The US government will get rid of it.

And that means MLP is free game!

I personally, do not want the MLP copyright falling into the wrong hands

Because that could be catastrophic for the Brony Fandom

That is actually 100% true

In the USA if a company doesn't enforce its copyright they end that claim. meaning that, that company no long owns the rights for that product. Like I said fair game, and that can lead to actual copyright problems,

Intellectual Property rights in the U.S. are so dumb and inefficient. I'm in an IP class right now and it's just stupid how it's set up.

 

This is Hasbro protecting their butts since this guy really made it look close to the real show. It is a derivative work and derivative works are liable to be C&D by the original owner. I saw people ask "well why is Friendship is Witchcraft still going?" well because FiW is a parody work and parody is acceptable under the definition of fair use. This animation is not acceptable under fair use to Hasbro because it is not parody, it's not educational, and it's not being used as part of a criticism/commentary of something.

Gah. 1000 "screw you"s to Hasbro. I'm getting awfully sick of this C&D crap. Hasbro just wants to keep itself on the pedastal. Before you know it, they'll be hitting on us brony musicians who remix official songs of the show. Even if Buttons was just a background character from the show, it still doesn't give Hasbro the right to C&D JanAnimations. They completely forgot the "Fair Use" laws. Someone seriously needs to step in and deal with this stuff.

Well to be fair, most of us aren't teens, myself included.

 

I also don't think that would work though because Hasbro isn't the bad guy here. Really, it's just a bad combination of paranoid parents, corporate responsibility, creative passion, and obsolete licensing laws.

 

To really treat the route of the problem won't and can't be done with a charged, spirited protest, no that would be too easy. Changing the rules will take time, and I'd say we've already done a great job by just doing what we love. The more we push back against the norms, the more they have to give. Slowly and surely, like a tide beating against a rock.

What I mearly meant was a widely held thought that established influence and status, regardless of how it's achieved, is inherently evil.

 

Accompanied by this is the thought that any action taken by a group or individual in a higher standing against someone of lower standing is tantamount to undue censorship or repression, rather than seeing if the grievance being addressed is legitimate.

 

Again, I agree that what Hasbro is doing is utterly juvenile and unfair, but it hardly constitutes an act of war.

It doesnt but it does raise an issue about what boundaries of censorship there should be.

Yes, I totally agree with that. If you can't make a simple tribute that gets everything down to the light hearted spirit of it's source material than what's next? Does someone singing karaoke count as stealing that song?

You need to read those laws. They are for educational,nonprofit and personal use. These videos were clearly not for personal use, and they were put there for entertainment purposes.

Well, the reason a lot of people are "jumping ship" so to speak now, is because this is happening suddenly, and in a great number. So far Jan is number 4 on a list of C&D issued by hasbro this week alone. As for now I'd wait and see if it ramps up any, if they continue on this path, then we may be in view of a crusade against the fandom.

 

Can anyone clarify, were their 3 other takedowns this WEEK or is this person confusing Hasbro's C&D's over the period of several months? Hasbro has done very few c&d's.

 

I know people are upset (and it really does suck) but Jan ainimations were making animation that was indistinguishable from Hasbro's in terms of quality. They were using characters (Button Mash, CMC) that were Hasbro properties. They were doing this (i believe) while receiving ad revenue thru their youtube channel ads which is a way of earning unauthorized income.  All of this happened while they did not get permission from Hasbro to use their characters.

 

Hasbro has been incredibly lenient to this community and allowed MANY things to occur. The fact that Jan Animations had this many videos released before they took it down is a good thing. Hopefully they can up their vids to yayponies or put out a bootleg dvd to sell cheap at cons. But Jan Animations was reaching a point of no return where Hasbro was going to eventually respond and take action. It's Fighting is Magic all over again. You aim too high and you get burnt.

 

But the reason why stuff like the merchandise on WeLoveFine exists is because it is offically liscenced and Hasbro makes some money off the top. Hasbro did not have that relationship with Jan Animations. Nothing was authorized and that income was not going to Hasbro. Other fannon works don't reach that same level of quality where it can be easily confused with Hasbro's official show.  They issued a C&D but its Jan Animations who didnt fight it and took down their work.

 

Again this sucks but lets all take a chill pill before we start a crusade against Hasbro or threaten to stop making pony content at all. This fandom is not under attack unless there's a consistant barrage of c&d's that take this a whole other step further.

Wait.. Didn't JanAnimations receive legit consent to make some of those vids? including the one used for the documentary?

 

TBH this sounds like an over zealous lawyer that needs a swift kick to the nuts moreso than Hasbro themselves. Someone should contact hasbro itself regarding this and see where it goes. It wouldn't be the first time a companies sue happy lawyer went AWOL and just started C&D'ing everything they found on the internet.
